 5月31日(ri),國務院印發(fa)的《扎實穩住(zhu)經濟(ji)一攬(lan)子政策措施》的通(tong)知對外公布(bu)。

任務要求六:加強司法公開

2018年(nian):(1)推(tui)進司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)規范化(hua)標準(zhun)化(hua)建(jian)(jian)設。圍繞人(ren)民(min)(min)法(fa)(fa)(fa)(fa)院工(gong)(gong)作(zuo)重點領(ling)域、關鍵(jian)環(huan)節(jie)和(he)人(ren)民(min)(min)群眾關注(zhu)的重要司(si)法(fa)(fa)(fa)(fa)信(xin)息(xi),總結各地法(fa)(fa)(fa)(fa)院工(gong)(gong)作(zuo)經(jing)驗,加(jia)強司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)規范化(hua)標準(zhun)化(hua)建(jian)(jian)設,積極研究(jiu)出臺相關技術標準(zhun)和(he)操作(zuo)規程(cheng),強化(hua)對下監督和(he)分(fen)類指(zhi)導,不斷提升司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)質效。(2)健全(quan)司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)形(xing)(xing)式(shi)。司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)形(xing)(xing)式(shi)應(ying)當(dang)因地制宜(yi)、因事而定、權威規范、注(zhu)重實效,便于公(gong)(gong)(gong)(gong)(gong)眾及(ji)(ji)時準(zhun)確獲(huo)取,堅決防止形(xing)(xing)式(shi)主義。(3)明確司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)責(ze)(ze)任主體。建(jian)(jian)立健全(quan)司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)協調機制,公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)內容涉及(ji)(ji)多個(ge)人(ren)民(min)(min)法(fa)(fa)(fa)(fa)院、人(ren)民(min)(min)法(fa)(fa)(fa)(fa)院多個(ge)內設機構或者其他單位的,應(ying)當(dang)經(jing)協調一致后予以公(gong)(gong)(gong)(gong)(gong)開(kai)(kai),確保司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)信(xin)息(xi)準(zhun)確完整。(4)完善司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)流程(cheng)和(he)管理機制。建(jian)(jian)立健全(quan)司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)工(gong)(gong)作(zuo)機制,完善工(gong)(gong)作(zuo)流程(cheng),明確管理責(ze)(ze)任,規范有(you)序推(tui)進司(si)法(fa)(fa)(fa)(fa)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)工(gong)(gong)作(zuo)。

任務要求七:健全解決執行難長效機制

2019年:(1)推進執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)工(gong)(gong)作(zuo)部(bu)門(men)協作(zuo)聯(lian)(lian)(lian)動(dong)(dong)機(ji)制化(hua)(hua)。落(luo)實(shi)中(zhong)(zhong)央政法(fa)(fa)委(wei)提出的“共(gong)建、共(gong)治、共(gong)享(xiang)”要(yao)求,由政法(fa)(fa)委(wei)牽頭各協作(zuo)、協助(zhu)(zhu)部(bu)門(men)健全聯(lian)(lian)(lian)席會議制度(du),把(ba)執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)聯(lian)(lian)(lian)動(dong)(dong)各項工(gong)(gong)作(zuo)納(na)入(ru)各聯(lian)(lian)(lian)動(dong)(dong)部(bu)門(men)職責(ze)范圍,明確任(ren)務,夯(hang)實(shi)責(ze)任(ren),加(jia)(jia)強考核。(2)加(jia)(jia)強執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)工(gong)(gong)作(zuo)綜(zong)治考核。推動(dong)(dong)將執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)工(gong)(gong)作(zuo)作(zuo)為(wei)全面(mian)依法(fa)(fa)治國的重要(yao)內(nei)容統籌部(bu)署,把(ba)解決執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)難(nan)納(na)入(ru)各地(di)依法(fa)(fa)治省(區、市)指標體系(xi)(xi)。(3)加(jia)(jia)強基(ji)層執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)工(gong)(gong)作(zuo)網格化(hua)(hua)管理(li)(li)。推動(dong)(dong)綜(zong)治平臺與(yu)(yu)人(ren)民(min)(min)法(fa)(fa)院執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)指揮、辦(ban)案(an)(an)平臺互聯(lian)(lian)(lian)互通,實(shi)時向基(ji)層綜(zong)治網格員(yuan)推送失(shi)信(xin)被執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)人(ren)名單(dan)、限制消(xiao)費人(ren)員(yuan)名單(dan)、懸(xuan)賞(shang)公(gong)告等執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)信(xin)息(xi)。(4)全面(mian)推行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)團隊辦(ban)案(an)(an)模式。實(shi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)以法(fa)(fa)官(guan)為(wei)主導的“法(fa)(fa)官(guan)+法(fa)(fa)官(guan)助(zhu)(zhu)理(li)(li)(執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)員(yuan))+法(fa)(fa)警+書(shu)記(ji)員(yuan)”團隊辦(ban)案(an)(an)模式,優化(hua)(hua)團隊之間、團隊內(nei)部(bu)的任(ren)務分工(gong)(gong)和(he)職權劃(hua)分,完善(shan)“人(ren)員(yuan)分類(lei)、事(shi)務集約、權責(ze)清晰、配合順暢”的執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)權運(yun)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)模式。(5)積極引入(ru)專(zhuan)業(ye)力(li)量參(can)與(yu)(yu)執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)。建立健全仲裁、公(gong)證、律師(shi)、會計、審計等專(zhuan)業(ye)機(ji)構和(he)人(ren)員(yuan)深度(du)參(can)與(yu)(yu)執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)的工(gong)(gong)作(zuo)機(ji)制。(6)健全繁(fan)簡(jian)分流、事(shi)務集約的執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)權運(yun)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)機(ji)制。執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)指揮中(zhong)(zhong)心對(dui)執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)案(an)(an)件進行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)類(lei)型化(hua)(hua)處(chu)理(li)(li),實(shi)現(xian)“簡(jian)案(an)(an)快執(zhi)(zhi)(zhi),難(nan)案(an)(an)精執(zhi)(zhi)(zhi)”。(7)完善(shan)“1+2+N”執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)信(xin)息(xi)化(hua)(hua)系(xi)(xi)統。大力(li)推行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)文檔電子化(hua)(hua)和(he)電子卷宗(zong)即時生(sheng)成,實(shi)現(xian)系(xi)(xi)統對(dui)執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)信(xin)息(xi)資源(yuan)的智能化(hua)(hua)讀取、識別,推動(dong)(dong)法(fa)(fa)律文書(shu)自動(dong)(dong)生(sheng)成、關鍵節點(dian)自動(dong)(dong)回填,為(wei)法(fa)(fa)官(guan)提供(gong)智力(li)支(zhi)持與(yu)(yu)輔助(zhu)(zhu)性、事(shi)務性工(gong)(gong)作(zuo)支(zhi)持。(8)加(jia)(jia)快推進執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)指揮中(zhong)(zhong)心實(shi)體化(hua)(hua)運(yun)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)。加(jia)(jia)強執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)指揮中(zhong)(zhong)心制度(du)建設。(9)完善(shan)失(shi)信(xin)懲戒系(xi)(xi)統。通過國家“互聯(lian)(lian)(lian)網+監管”系(xi)(xi)統及全國信(xin)用信(xin)息(xi)共(gong)享(xiang)平臺,推進失(shi)信(xin)被執(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)(xing)人(ren)信(xin)息(xi)與(yu)(yu)公(gong)安、民(min)(min)政、人(ren)力(li)資源(yuan)社會保(bao)障、自然資源(yuan)、住房城(cheng)鄉(xiang)建設等公(gong)共(gong)信(xin)用信(xin)息(xi)實(shi)現(xian)資源(yuan)共(gong)享(xiang)。

任務要求八:疫情期間開展支持復工復產的司法審判工作

2020年:(1)充(chong)(chong)分(fen)發揮(hui)執行(xing)(xing)工作(zuo)(zuo)的(de)服務保障作(zuo)(zuo)用(yong)。在涉(she)疫(yi)情執行(xing)(xing)案件辦理(li)過程中(zhong),強(qiang)化(hua)善意文明執行(xing)(xing)理(li)念,依法(fa)審慎(shen)采取強(qiang)制執行(xing)(xing)措(cuo)施。(2)準確(que)把握查(cha)封措(cuo)施的(de)法(fa)律(lv)界限。對受疫(yi)情影響(xiang)導(dao)致生(sheng)產(chan)生(sheng)活困難的(de)被執行(xing)(xing)人,在不(bu)影響(xiang)債權實(shi)現的(de)前提(ti)下,人民法(fa)院應當選擇適當的(de)查(cha)封措(cuo)施。(3)強(qiang)化(hua)應用(yong)執行(xing)(xing)和解制度。加強(qiang)對因疫(yi)情影響(xiang)而危困企業的(de)司法(fa)救助。(4)充(chong)(chong)分(fen)利用(yong)信(xin)息化(hua)手段推動(dong)執行(xing)(xing)工作(zuo)(zuo)。充(chong)(chong)分(fen)利用(yong)“智(zhi)慧法(fa)院”建設成果,特別是以現代信(xin)息技(ji)術為支撐的(de)執行(xing)(xing)信(xin)息化(hua)系統。
