國常會:加快內外貿一體化發展,推進內外貿產品同線同標同質
12月1日,國務(wu)院召開常務(wu)會議,聽取推動高質量發(fa)展綜合督查情況匯報,研究(jiu)明確(que)關(guan)于加(jia)快內外貿一體化發(fa)展的若干措施。
會議(yi)(yi)充分肯定了推(tui)動(dong)高(gao)質量發展(zhan)綜(zong)合督查(cha)工作(zuo)(zuo)取得的(de)(de)(de)積極(ji)成效(xiao),指出此次督查(cha)發現的(de)(de)(de)問(wen)題集中(zhong)(zhong)反(fan)映了企業群眾的(de)(de)(de)急難愁盼和工作(zuo)(zuo)推(tui)進的(de)(de)(de)堵點難點。要(yao)聚焦推(tui)動(dong)高(gao)質量發展(zhan),督促有關方(fang)面對照督查(cha)發現的(de)(de)(de)問(wen)題一項一項抓好整改,舉(ju)一反(fan)三(san)改進相關工作(zuo)(zuo),切(qie)實推(tui)動(dong)黨(dang)中(zhong)(zhong)央(yang)決策部署落地落實。要(yao)高(gao)度重(zhong)視(shi)、深入研究督查(cha)中(zhong)(zhong)收集到的(de)(de)(de)意(yi)見建議(yi)(yi),在制定出臺有關政策措施時積極(ji)予(yu)以吸收。
會(hui)議指出(chu),加(jia)快內(nei)(nei)外(wai)貿(mao)一(yi)體化(hua)發(fa)(fa)展(zhan)是(shi)構(gou)建新發(fa)(fa)展(zhan)格局、推動(dong)高質(zhi)(zhi)量(liang)發(fa)(fa)展(zhan)的內(nei)(nei)在要(yao)求(qiu)。要(yao)對標(biao)(biao)國際(ji)先進(jin)(jin)水平,加(jia)快調整完善國內(nei)(nei)相關規則(ze)、規制(zhi)、管理、標(biao)(biao)準等,促進(jin)(jin)內(nei)(nei)外(wai)貿(mao)標(biao)(biao)準銜接(jie)、檢驗認證銜接(jie)、監管銜接(jie),推進(jin)(jin)內(nei)(nei)外(wai)貿(mao)產品同(tong)(tong)線(xian)同(tong)(tong)標(biao)(biao)同(tong)(tong)質(zhi)(zhi)。要(yao)聚焦企(qi)業(ye)需(xu)求(qiu)和市場反饋及(ji)時優化(hua)政策,切(qie)實打通阻礙內(nei)(nei)外(wai)貿(mao)一(yi)體化(hua)的關鍵(jian)堵點(dian),助(zhu)力企(qi)業(ye)在國內(nei)(nei)國際(ji)兩個市場順暢切(qie)換。要(yao)優化(hua)內(nei)(nei)外(wai)貿(mao)一(yi)體化(hua)發(fa)(fa)展(zhan)環境(jing),落實好相關財政金融支(zhi)持(chi)政策,共同(tong)(tong)促進(jin)(jin)內(nei)(nei)外(wai)貿(mao)高質(zhi)(zhi)量(liang)發(fa)(fa)展(zhan)。
中國人民銀行等八部門:推出金融助力民營企業發展壯大25條舉措
近日,中國人(ren)民銀行、金(jin)(jin)融(rong)監管總局(ju)、中國證(zheng)監會、國家外(wai)匯局(ju)、國家發展(zhan)改革(ge)委、工(gong)業和信息化(hua)部、財政部、全(quan)國工(gong)商聯等八部門聯合印發《關于強化(hua)金(jin)(jin)融(rong)支持(chi)舉措 助力民營(ying)經(jing)濟發展(zhan)壯(zhuang)大的(de)通知》(以下(xia)簡稱《通知》),提出支持(chi)民營(ying)經(jing)濟的(de)25條具體(ti)舉措。
《通知》明(ming)確金(jin)融服務民(min)營(ying)企(qi)業(ye)(ye)(ye)目標和重點(dian)。總量(liang)上,銀行(xing)業(ye)(ye)(ye)金(jin)融機(ji)構(gou)要通過制(zhi)定民(min)營(ying)企(qi)業(ye)(ye)(ye)年度服務目標、提高服務民(min)營(ying)企(qi)業(ye)(ye)(ye)相關業(ye)(ye)(ye)務在績效考核中的(de)(de)權重等(deng),加大(da)對民(min)營(ying)企(qi)業(ye)(ye)(ye)的(de)(de)金(jin)融支(zhi)持(chi)力度,逐步(bu)提升民(min)營(ying)企(qi)業(ye)(ye)(ye)貸款占(zhan)比(bi)。結構(gou)上,加大(da)對科技創(chuang)新(xin)、“專精特新(xin)”、綠色低碳(tan)、產業(ye)(ye)(ye)基礎再造工(gong)程等(deng)重點(dian)領域以及民(min)營(ying)中小微企(qi)業(ye)(ye)(ye)的(de)(de)支(zhi)持(chi)力度。
《通(tong)知》強(qiang)調要從民(min)(min)(min)(min)營(ying)(ying)企業(ye)融(rong)(rong)(rong)資(zi)需求(qiu)特點出發(fa),著力暢通(tong)信貸(dai)(dai)(dai)、債(zhai)券、股(gu)(gu)權(quan)等(deng)多元化(hua)融(rong)(rong)(rong)資(zi)渠道。銀行(xing)業(ye)金(jin)融(rong)(rong)(rong)機(ji)構(gou)要加(jia)大(da)(da)(da)首貸(dai)(dai)(dai)、信用貸(dai)(dai)(dai)支持(chi)力度,積極開展(zhan)產業(ye)鏈(lian)供應(ying)鏈(lian)金(jin)融(rong)(rong)(rong)服務(wu),主動做好(hao)民(min)(min)(min)(min)營(ying)(ying)企業(ye)資(zi)金(jin)接續服務(wu),不(bu)盲(mang)目停貸(dai)(dai)(dai)、壓(ya)貸(dai)(dai)(dai)、抽(chou)貸(dai)(dai)(dai)、斷貸(dai)(dai)(dai),同時抓(zhua)好(hao)促發(fa)展(zhan)和防風險。優化(hua)民(min)(min)(min)(min)營(ying)(ying)企業(ye)債(zhai)務(wu)融(rong)(rong)(rong)資(zi)工具注冊機(ji)制(zhi),充分發(fa)揮(hui)民(min)(min)(min)(min)營(ying)(ying)企業(ye)債(zhai)券融(rong)(rong)(rong)資(zi)支持(chi)工具作(zuo)用,擴大(da)(da)(da)民(min)(min)(min)(min)營(ying)(ying)企業(ye)債(zhai)券融(rong)(rong)(rong)資(zi)規模。鼓(gu)勵和引導(dao)機(ji)構(gou)投(tou)資(zi)者積極科學配置民(min)(min)(min)(min)營(ying)(ying)企業(ye)債(zhai)券,加(jia)大(da)(da)(da)對(dui)民(min)(min)(min)(min)營(ying)(ying)企業(ye)債(zhai)券投(tou)資(zi)力度。支持(chi)民(min)(min)(min)(min)營(ying)(ying)企業(ye)上市(shi)融(rong)(rong)(rong)資(zi)和并購重組,發(fa)揮(hui)區(qu)域(yu)性股(gu)(gu)權(quan)市(shi)場、股(gu)(gu)權(quan)投(tou)資(zi)基金(jin)對(dui)民(min)(min)(min)(min)營(ying)(ying)企業(ye)的支持(chi)服務(wu)作(zuo)用,擴大(da)(da)(da)優質(zhi)民(min)(min)(min)(min)營(ying)(ying)企業(ye)股(gu)(gu)權(quan)融(rong)(rong)(rong)資(zi)規模。加(jia)大(da)(da)(da)外匯便(bian)利(li)化(hua)政(zheng)(zheng)策和服務(wu)供給,通(tong)過提升經常項目收支便(bian)利(li)化(hua)水(shui)平、完善跨境(jing)投(tou)融(rong)(rong)(rong)資(zi)便(bian)利(li)化(hua)政(zheng)(zheng)策、優化(hua)跨境(jing)金(jin)融(rong)(rong)(rong)外匯特色服務(wu),支持(chi)民(min)(min)(min)(min)營(ying)(ying)企業(ye)“走出去(qu)”“引進來”。
《通知(zhi)》提出(chu),要綜合(he)運用(yong)貨幣(bi)政(zheng)策工(gong)具、財政(zheng)獎(jiang)補和(he)保(bao)(bao)險保(bao)(bao)障等措施,提升(sheng)金(jin)(jin)融(rong)機(ji)構服(fu)務民(min)(min)營經(jing)濟(ji)的(de)積極性。加強(qiang)(qiang)部門合(he)作(zuo),完(wan)善信(xin)用(yong)信(xin)息(xi)共享(xiang)、融(rong)資擔保(bao)(bao)、便利票據貼(tie)現(xian)、應收賬(zhang)款確權(quan)、稅收等配套政(zheng)策和(he)機(ji)制,增強(qiang)(qiang)民(min)(min)營經(jing)濟(ji)金(jin)(jin)融(rong)承載力。金(jin)(jin)融(rong)機(ji)構要加強(qiang)(qiang)宣傳(chuan)解讀,主動將金(jin)(jin)融(rong)支持政(zheng)策、金(jin)(jin)融(rong)產品(pin)和(he)服(fu)務信(xin)息(xi)推(tui)送至民(min)(min)營企業(ye)。各地金(jin)(jin)融(rong)管(guan)理、發展改革、工(gong)信(xin)、財稅、工(gong)商聯等部門加強(qiang)(qiang)溝(gou)通協調,強(qiang)(qiang)化督(du)促指導,提升(sheng)政(zheng)策實效(xiao)。
財政部等三部門:開展政府采購領域專項整治,重點整治設置歧視條款、圍標串標等“四類”行為
近日,財(cai)政(zheng)(zheng)部、公(gong)安(an)部、市場監管總(zong)局印(yin)發《關(guan)于開展2023年政(zheng)(zheng)府采(cai)購(gou)領域“四(si)類”違法違規(gui)行(xing)為專項整治工(gong)作(zuo)的通(tong)知》(以下(xia)簡(jian)稱《通(tong)知》),進一步規(gui)范(fan)政(zheng)(zheng)府采(cai)購(gou)市場秩序,持續優(you)化營商環境。
《通(tong)知》明確(que)工(gong)作重點(dian)將聚焦當前政府(fu)采購(gou)領域反映突出的采購(gou)人設置差(cha)別(bie)歧(qi)(qi)視條款(kuan)、代(dai)理機(ji)構(gou)亂收費、供(gong)應(ying)商(shang)(shang)提(ti)供(gong)虛假(jia)材料(liao)、供(gong)應(ying)商(shang)(shang)圍(wei)標(biao)(biao)(biao)串(chuan)標(biao)(biao)(biao)等(deng)(deng)“四類(lei)”違法(fa)違規(gui)行為開(kai)展(zhan)專項整治(zhi)。重點(dian)整治(zhi)以下內容:采購(gou)人傾斜照顧本(ben)地企業,以注冊(ce)地、所有制(zhi)形式(shi)、組(zu)織形式(shi)、股權結構(gou)、投(tou)資者國別(bie)、經營(ying)年限、經營(ying)規(gui)模、財務(wu)指標(biao)(biao)(biao)、產(chan)品或服務(wu)品牌等(deng)(deng)不合(he)理條件對供(gong)應(ying)商(shang)(shang)實行差(cha)別(bie)歧(qi)(qi)視待遇;代(dai)理機(ji)構(gou)違規(gui)收費、逾期(qi)不退還保證(zheng)金;供(gong)應(ying)商(shang)(shang)提(ti)供(gong)虛假(jia)的檢測(ce)報告(gao)、認證(zheng)證(zheng)書、合(he)同業績、中小企業聲(sheng)明函、制(zhi)造商(shang)(shang)授權函等(deng)(deng)材料(liao)謀取中標(biao)(biao)(biao);供(gong)應(ying)商(shang)(shang)成立多(duo)家公司(si)圍(wei)標(biao)(biao)(biao)串(chuan)標(biao)(biao)(biao),投(tou)標(biao)(biao)(biao)文件相互混裝、異常(chang)一(yi)(yi)致,投(tou)標(biao)(biao)(biao)報價呈規(gui)律性差(cha)異,投(tou)標(biao)(biao)(biao)保證(zheng)金從同一(yi)(yi)賬戶轉出等(deng)(deng)惡意串(chuan)通(tong)行為。
《通知》提(ti)出,本次檢查主要針對(dui)2022年1月1日以來啟動實施的(de)政府采購項(xiang)目。各省(sheng)(區、市)抽(chou)取的(de)采購代理(li)機(ji)(ji)構(gou)(gou)數量(liang)比(bi)率(lv)原則上(shang)不低于(yu)本省(sheng)(區、市)代理(li)機(ji)(ji)構(gou)(gou)總數的(de)10%,檢查總量(liang)不得(de)少(shao)于(yu)30家,各市、縣(xian)檢查數量(liang)由(you)省(sheng)級財(cai)政部門(men)統(tong)籌(chou)分(fen)解(jie)。財(cai)政部選(xuan)取北京、山西、貴州、四(si)川4個省(sheng)的(de)20家采購代理(li)機(ji)(ji)構(gou)(gou)對(dui)中央政府采購項(xiang)目進行重點(dian)檢查。每家采購代理(li)機(ji)(ji)構(gou)(gou)抽(chou)取的(de)項(xiang)目原則上(shang)不少(shao)于(yu)5個。

上海:對標世行新一輪營商環境評估體系 第二次修正“優化營商環境條例”
近期,上(shang)海(hai)(hai)市(shi)十六屆人大常委會(hui)第八次會(hui)議表決(jue)通過《上(shang)海(hai)(hai)市(shi)人民(min)代表大會(hui)常務委員會(hui)關于修(xiu)(xiu)改<上(shang)海(hai)(hai)市(shi)優化營(ying)商環境條(tiao)(tiao)例(li)>的(de)決(jue)定》(下(xia)稱(cheng):《決(jue)定》),此(ci)次修(xiu)(xiu)正后的(de)《上(shang)海(hai)(hai)市(shi)優化營(ying)商環境條(tiao)(tiao)例(li)》(以下(xia)簡稱(cheng)《條(tiao)(tiao)例(li)》)于今年12月1日起(qi)施行。
《上(shang)(shang)(shang)海(hai)(hai)市(shi)優(you)化(hua)營(ying)商環(huan)境(jing)(jing)條例》是上(shang)(shang)(shang)海(hai)(hai)營(ying)商環(huan)境(jing)(jing)建(jian)設的第(di)一部綜合性(xing)、基(ji)礎性(xing)法規,于(yu)2020年(nian)4月10日發(fa)布;2021年(nian)10月28日,上(shang)(shang)(shang)海(hai)(hai)市(shi)人大常(chang)委會(hui)(hui)對條例作了修(xiu)(xiu)正(zheng);今年(nian),世(shi)界銀行推出新一輪(lun)營(ying)商環(huan)境(jing)(jing)評估體(ti)系,上(shang)(shang)(shang)海(hai)(hai)啟動新一輪(lun)對標和迎(ying)評工作,上(shang)(shang)(shang)海(hai)(hai)市(shi)人大常(chang)委會(hui)(hui)啟動了對《上(shang)(shang)(shang)海(hai)(hai)市(shi)優(you)化(hua)營(ying)商環(huan)境(jing)(jing)條例》的第(di)二次修(xiu)(xiu)正(zheng)。
上海(hai)市(shi)(shi)發(fa)展和改(gai)革委員會表示,《條例》進一步強(qiang)化對標(biao)世界銀行營商(shang)環境(jing)新(xin)評(ping)估體(ti)系,固化完善了(le)(le)上海(hai)最(zui)近幾年(nian)優(you)(you)化營商(shang)環境(jing)工作的(de)經驗做法。這次《上海(hai)市(shi)(shi)優(you)(you)化營商(shang)環境(jing)條例》的(de)修正(zheng),在(zai)產(chan)權保護、優(you)(you)化中小企(qi)業(ye)融資環境(jing)、惠企(qi)政(zheng)(zheng)策落地機(ji)制(zhi)、健(jian)全商(shang)業(ye)糾紛解(jie)決機(ji)制(zhi)、完善辦理(li)破產(chan)相關制(zhi)度、規范執法行為等(deng)多方(fang)面(mian)都提出了(le)(le)許多新(xin)的(de)要求(qiu)。上海(hai)市(shi)(shi)發(fa)展改(gai)革委還透露,考慮在(zai)明年(nian)新(xin)一輪優(you)(you)化營商(shang)環境(jing)建設方(fang)案(an)過(guo)程中,積(ji)極優(you)(you)化完善具體(ti)的(de)配套政(zheng)(zheng)策措施,有針對性(xing)地解(jie)決一批(pi)企(qi)業(ye)關心的(de)難點堵點問題等(deng)。
上海(hai)市人大常委會(hui)介紹,此(ci)次修(xiu)正,既是(shi)貫徹(che)落實(shi)國(guo)家關于優(you)化(hua)營商(shang)(shang)(shang)環(huan)境最新部署的需要,又是(shi)結合世(shi)行新的評估體(ti)系(xi),固化(hua)完善上海(hai)優(you)化(hua)營商(shang)(shang)(shang)環(huan)境工(gong)作(zuo)的經驗做法,持(chi)續營造市場(chang)化(hua)、法治化(hua)、國(guo)際(ji)化(hua)一流營商(shang)(shang)(shang)環(huan)境的需要。22日表決(jue)通過(guo)的《決(jue)定》共三十七條,對多個方面做出規范(fan),包括(kuo):支持(chi)企(qi)(qi)業(ye)等經營主體(ti)開(kai)展環(huan)境、社會(hui)和治理(li)等可(ke)持(chi)續發(fa)展實(shi)踐,明確保護(hu)中(zhong)(zhong)(zhong)小(xiao)(xiao)股東合法權(quan)益等;建立企(qi)(qi)業(ye)知(zhi)識產權(quan)海(hai)外應急援(yuan)助(zhu)機制,建立健(jian)(jian)全商(shang)(shang)(shang)業(ye)秘密保護(hu)體(ti)系(xi)等;完善了(le)財政資金類惠企(qi)(qi)政策的相關規定,有序推動直(zhi)接惠企(qi)(qi)政策直(zhi)達(da)快享;優(you)化(hua)中(zhong)(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)融(rong)資環(huan)境,明確建立健(jian)(jian)全中(zhong)(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)涉訴(su)信息澄(cheng)清機制(完),避免(mian)對中(zhong)(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)正常貸款(kuan)造成不利影響。
《決定》明確推(tui)行(xing)市政(zheng)公(gong)用(yong)基礎設施服務可靠性(xing)監(jian)管(guan)計劃;健全糾紛化解(jie)(jie)(jie)(jie)相關制(zhi)度安(an)排(pai),推(tui)行(xing)勞動糾紛調解(jie)(jie)(jie)(jie)優先,建(jian)立涉外商事糾紛調解(jie)(jie)(jie)(jie)、仲裁、訴(su)訟一站(zhan)式解(jie)(jie)(jie)(jie)決工作機(ji)制(zhi);持續推(tui)進社(she)會(hui)信用(yong)體系建(jian)設,推(tui)行(xing)專用(yong)信用(yong)信息(xi)報告替代有無違法犯罪記錄證明,完善公(gong)共信用(yong)信息(xi)修復機(ji)制(zhi)等。
河北:修訂通過“優化營商環境條例” 新增要素環境和信用環境2個專章
11月(yue)30日,新修訂的《河(he)北省優化營商(shang)環境(jing)條例》(以下簡(jian)稱“《條例》”)經河(he)北省十四屆(jie)人大常(chang)委會(hui)第(di)六次會(hui)議表決通過,將于2024年(nian)1月(yue)1日起施行(xing)。
《條例(li)》聚焦(jiao)加快建(jian)設市(shi)場化、法(fa)治化、國際化一(yi)流營商環(huan)(huan)境(jing),新增(zeng)要素環(huan)(huan)境(jing)、信用環(huan)(huan)境(jing)2個專章,與原市(shi)場環(huan)(huan)境(jing)、政務環(huan)(huan)境(jing)、法(fa)治環(huan)(huan)境(jing)共同(tong)構(gou)成(cheng)基本(ben)框架(jia),由原來的7章65條修改為9章68條。
圍繞破(po)解市(shi)場主體遇到的痛(tong)點、難點、堵(du)點問題,《條(tiao)例(li)》規(gui)定,建(jian)立市(shi)場準(zhun)入(ru)效(xiao)能評(ping)估(gu)體系,及時排查、清(qing)(qing)理或者(zhe)(zhe)廢除(chu)市(shi)場準(zhun)入(ru)不(bu)(bu)合理限(xian)(xian)制和(he)隱性(xing)壁壘。加強反(fan)(fan)壟(long)斷(duan)、反(fan)(fan)不(bu)(bu)正當(dang)競(jing)爭執法(fa),預防和(he)制止(zhi)(zhi)壟(long)斷(duan)行(xing)(xing)為、不(bu)(bu)正當(dang)競(jing)爭行(xing)(xing)為以及濫用(yong)行(xing)(xing)政(zheng)權(quan)力排除(chu)、限(xian)(xian)制競(jing)爭行(xing)(xing)為。對(dui)涉(she)(she)企(qi)政(zheng)策(ce)進(jin)行(xing)(xing)清(qing)(qing)理、整合,對(dui)不(bu)(bu)符合市(shi)場規(gui)律、不(bu)(bu)適應現實(shi)需要和(he)發(fa)展趨(qu)勢、不(bu)(bu)具備(bei)兌(dui)現條(tiao)件、不(bu)(bu)明確兌(dui)現流程的涉(she)(she)企(qi)政(zheng)策(ce)進(jin)行(xing)(xing)修改、廢止(zhi)(zhi),避免政(zheng)策(ce)沖突(tu)。推進(jin)一(yi)業(ye)(ye)一(yi)證(zheng)(zheng)、證(zheng)(zheng)照聯辦、一(yi)證(zheng)(zheng)多(duo)址等改革,推行(xing)(xing)企(qi)業(ye)(ye)登記全(quan)程網上(shang)辦理,實(shi)行(xing)(xing)一(yi)次認證(zheng)(zheng)、全(quan)網通辦。取消(xiao)區域(yu)性(xing)、行(xing)(xing)業(ye)(ye)性(xing)或者(zhe)(zhe)部門間中介機構執業(ye)(ye)限(xian)(xian)制、限(xian)(xian)額管理,發(fa)揮其法(fa)律服(fu)務、審計鑒證(zheng)(zheng)、招標投標、資產評(ping)估(gu)等服(fu)務作用(yong)。
圍(wei)繞(rao)提升(sheng)政(zheng)務(wu)(wu)服(fu)(fu)務(wu)(wu)質效,《條例》規定,持續推(tui)(tui)進政(zheng)務(wu)(wu)服(fu)(fu)務(wu)(wu)標(biao)(biao)準(zhun)化、規范化、便(bian)(bian)利化,實(shi)行(xing)同一(yi)(yi)事(shi)(shi)項(xiang)(xiang)無差別(bie)受(shou)理(li)、同標(biao)(biao)準(zhun)辦(ban)(ban)理(li),規范網上辦(ban)(ban)事(shi)(shi)服(fu)(fu)務(wu)(wu)、辦(ban)(ban)事(shi)(shi)指引,實(shi)現政(zheng)務(wu)(wu)服(fu)(fu)務(wu)(wu)事(shi)(shi)項(xiang)(xiang)全程(cheng)網辦(ban)(ban)、一(yi)(yi)網通辦(ban)(ban)、好辦(ban)(ban)易辦(ban)(ban)。編制(zhi)并公布(bu)證明事(shi)(shi)項(xiang)(xiang)清(qing)單(dan),不得在證明事(shi)(shi)項(xiang)(xiang)清(qing)單(dan)之外索要證明。公布(bu)惠(hui)(hui)企政(zheng)策目錄清(qing)單(dan),推(tui)(tui)行(xing)惠(hui)(hui)企政(zheng)策免申(shen)即(ji)享(xiang),符(fu)合條件的企業免予(yu)申(shen)報,直接享(xiang)受(shou)惠(hui)(hui)企政(zheng)策。國家(jia)機關(guan)工(gong)作人員應當依法(fa)履行(xing)職責,主(zhu)動(dong)靠前服(fu)(fu)務(wu)(wu),規范政(zheng)商(shang)交往(wang)行(xing)為,不得干擾經(jing)營主(zhu)體正(zheng)常經(jing)營。推(tui)(tui)動(dong)納稅事(shi)(shi)項(xiang)(xiang)全省通辦(ban)(ban),推(tui)(tui)行(xing)全面(mian)數字化的電(dian)子(zi)(zi)發票及其他電(dian)子(zi)(zi)票據等便(bian)(bian)利措(cuo)施。創(chuang)新集成工(gong)程(cheng)建設項(xiang)(xiang)目審批(pi)模式,實(shi)行(xing)統一(yi)(yi)受(shou)理(li)、多(duo)規合一(yi)(yi)、多(duo)評合一(yi)(yi)、多(duo)測合一(yi)(yi)、并聯審批(pi),提高審批(pi)效能等。
圍繞土地(di)(di)(di)、數(shu)(shu)據(ju)、資金、人才等(deng)要素供(gong)應方面,《條例》規定(ding),建(jian)(jian)立項目(mu)落地(di)(di)(di)保障(zhang)機制(zhi)和(he)(he)承(cheng)諾(nuo)辦結制(zhi)度,實(shi)行項目(mu)跟蹤服(fu)(fu)務(wu)責(ze)任制(zhi),及時協(xie)調解決項目(mu)審批、要素保障(zhang)、建(jian)(jian)設(she)和(he)(he)生(sheng)(sheng)產經營(ying)中的(de)(de)相(xiang)關(guan)問題。供(gong)應土地(di)(di)(di)應當(dang)執行國家(jia)的(de)(de)土地(di)(di)(di)政(zheng)策,優化(hua)對(dui)用(yong)(yong)地(di)(di)(di)規劃、項目(mu)招商、土地(di)(di)(di)供(gong)應、供(gong)后管理(li)(li)(li)和(he)(he)退出等(deng)各環節的(de)(de)協(xie)同監管和(he)(he)服(fu)(fu)務(wu),實(shi)行產業(ye)用(yong)(yong)地(di)(di)(di)全(quan)周期管理(li)(li)(li)。推進公共數(shu)(shu)據(ju)開放,鼓勵優先開放對(dui)民生(sheng)(sheng)服(fu)(fu)務(wu)、社會治理(li)(li)(li)和(he)(he)產業(ye)發展具有(you)重要價(jia)值的(de)(de)數(shu)(shu)據(ju)。公用(yong)(yong)企業(ye)事業(ye)單位實(shi)行報(bao)裝全(quan)流(liu)程網(wang)上辦理(li)(li)(li),向經營(ying)主體提供(gong)安全(quan)、方便、快捷、穩定(ding)和(he)(he)價(jia)格合理(li)(li)(li)的(de)(de)服(fu)(fu)務(wu)。完善融資支持制(zhi)度,降低中小(xiao)微企業(ye)擔保費率等(deng)。
圍(wei)繞更好保(bao)護(hu)企業合法(fa)(fa)(fa)權(quan)(quan)益,《條例》規定(ding)(ding)(ding),在制(zhi)(zhi)定(ding)(ding)(ding)涉及(ji)(ji)經(jing)營(ying)主(zhu)體經(jing)濟活動的(de)(de)(de)規定(ding)(ding)(ding)時,應(ying)當(dang)進(jin)行(xing)(xing)(xing)(xing)公(gong)平競(jing)爭審查。對(dui)涉企政(zheng)(zheng)(zheng)策(ce)進(jin)行(xing)(xing)(xing)(xing)調整的(de)(de)(de),應(ying)當(dang)根(gen)據(ju)實(shi)(shi)際(ji)設置合理(li)過(guo)渡期,但涉及(ji)(ji)國家安全和(he)公(gong)布后不立即施行(xing)(xing)(xing)(xing)將有礙施行(xing)(xing)(xing)(xing)的(de)(de)(de)除(chu)外。建立健全行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)裁量(liang)權(quan)(quan)基準(zhun)制(zhi)(zhi)度,對(dui)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)處罰、行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)許可、行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)征收(shou)征用、行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)確認、行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)強制(zhi)(zhi)、行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)檢查等(deng)(deng)法(fa)(fa)(fa)定(ding)(ding)(ding)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)事(shi)項中的(de)(de)(de)原(yuan)則性(xing)規定(ding)(ding)(ding),或者具有一定(ding)(ding)(ding)彈性(xing)的(de)(de)(de)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)權(quan)(quan)限(xian)、裁量(liang)幅度等(deng)(deng)內(nei)容進(jin)行(xing)(xing)(xing)(xing)細(xi)化量(liang)化,并向社(she)會公(gong)布。嚴(yan)格執(zhi)(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)公(gong)示制(zhi)(zhi)度、行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)全過(guo)程記錄制(zhi)(zhi)度、重大行(xing)(xing)(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)決定(ding)(ding)(ding)法(fa)(fa)(fa)制(zhi)(zhi)審核制(zhi)(zhi)度,推進(jin)嚴(yan)格規范公(gong)正文明執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa),推行(xing)(xing)(xing)(xing)告知、提(ti)醒、勸導等(deng)(deng)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)方式。按照鼓(gu)勵創新(xin)和(he)發展的(de)(de)(de)原(yuan)則,對(dui)新(xin)技(ji)術(shu)、新(xin)產業、新(xin)業態、新(xin)模式實(shi)(shi)行(xing)(xing)(xing)(xing)包容審慎(shen)監管(guan),不得簡單化禁止或者不予(yu)監管(guan)等(deng)(deng)。
圍繞完善社會(hui)信用體系,《條例》規定,加強(qiang)(qiang)政(zheng)(zheng)務誠信建設,健全政(zheng)(zheng)府(fu)守(shou)信踐諾機(ji)(ji)制,履(lv)行向經(jing)營主體依法(fa)作出的政(zheng)(zheng)策承(cheng)諾和依法(fa)訂立的各類(lei)合(he)(he)同,不(bu)得以(yi)(yi)行政(zheng)(zheng)區(qu)劃調整(zheng)、政(zheng)(zheng)府(fu)換屆、機(ji)(ji)構或者職能調整(zheng)以(yi)(yi)及相關(guan)(guan)責任人員更替等(deng)為(wei)由違約(yue)(yue)(yue)毀(hui)約(yue)(yue)(yue)。經(jing)營主體應(ying)當增(zeng)強(qiang)(qiang)法(fa)治意(yi)識、恪守(shou)契(qi)約(yue)(yue)(yue)精神、加強(qiang)(qiang)信用自律(lv)、遵守(shou)行業規約(yue)(yue)(yue)和職業道德(de),誠實履(lv)約(yue)(yue)(yue)、公(gong)(gong)(gong)平競爭。司法(fa)機(ji)(ji)關(guan)(guan)應(ying)當加強(qiang)(qiang)司法(fa)公(gong)(gong)(gong)信建設,強(qiang)(qiang)化內部監督(du),完善制約(yue)(yue)(yue)機(ji)(ji)制,推進司法(fa)公(gong)(gong)(gong)開,嚴格(ge)公(gong)(gong)(gong)正(zheng)司法(fa)。國(guo)家機(ji)(ji)關(guan)(guan)、事業單位和國(guo)有(you)企業應(ying)當按照(zhao)合(he)(he)同約(yue)(yue)(yue)定及時(shi)支付賬款(kuan)(kuan)(kuan),不(bu)得以(yi)(yi)內部人員變更、履(lv)行內部付款(kuan)(kuan)(kuan)流程,或在合(he)(he)同未作約(yue)(yue)(yue)定情況下以(yi)(yi)等(deng)待竣工驗收批復、決算審(shen)計等(deng)為(wei)由,拒絕(jue)或者延遲(chi)支付賬款(kuan)(kuan)(kuan)等(deng)。
