市場監管總局:開展整治濫用行政權力排除、限制競爭專項行動

近日,市(shi)場(chang)監管總局發(fa)(fa)布信息,自2025年4月至(zhi)12月部署開展整治濫用(yong)行政權力(li)排除、限(xian)制(zhi)競爭專項(xiang)(xiang)行動(dong)(dong)。整治重點包括限(xian)制(zhi)企業(ye)自主遷(qian)移、阻礙商品要素自由流(liu)動(dong)(dong)、妨礙企業(ye)公(gong)平(ping)參與異地經(jing)營、設(she)置地方(fang)保護和市(shi)場(chang)分割隱性門檻四大(da)類(lei)突出(chu)問題。通(tong)過開展專項(xiang)(xiang)行動(dong)(dong),將集(ji)中(zhong)查處一(yi)批重點案件,推動(dong)(dong)修訂廢除一(yi)批妨礙全國(guo)統一(yi)市(shi)場(chang)和公(gong)平(ping)競爭的(de)政策措施(shi),著力(li)解決人民群眾和經(jing)營主體關心關切的(de)濫用(yong)行政權力(li)排除、限(xian)制(zhi)競爭突出(chu)問題,支持各類(lei)企業(ye)在(zai)公(gong)平(ping)競爭中(zhong)成(cheng)長(chang)壯(zhuang)大(da),服務經(jing)濟社會高質量發(fa)(fa)展。

限制(zhi)(zhi)企(qi)業自主遷(qian)(qian)移類問題(ti)包括,濫(lan)用(yong)行(xing)(xing)政(zheng)權(quan)力強制(zhi)(zhi)或(huo)者(zhe)變(bian)相強制(zhi)(zhi)外地企(qi)業在本(ben)(ben)地投資(zi)(zi)、注冊(ce)或(huo)者(zhe)設立分支機(ji)構的行(xing)(xing)為;濫(lan)用(yong)行(xing)(xing)政(zheng)權(quan)力制(zhi)(zhi)發(fa)文件(jian)(jian)要求(qiu)企(qi)業在一定(ding)期(qi)限內將登記注冊(ce)、經營納稅等保(bao)持在本(ben)(ben)地,或(huo)者(zhe)要求(qiu)企(qi)業在遷(qian)(qian)出時全額或(huo)部分返還(huan)財(cai)政(zheng)獎補資(zi)(zi)金的行(xing)(xing)為;濫(lan)用(yong)行(xing)(xing)政(zheng)權(quan)力以歧(qi)視性資(zi)(zi)格條件(jian)(jian)等為企(qi)業跨(kua)區域遷(qian)(qian)移設置障礙的行(xing)(xing)為等。

阻礙(ai)(ai)商品(pin)(pin)要(yao)素自由流動類問題包括,濫用(yong)(yong)行(xing)(xing)政(zheng)(zheng)權力(li)指定(ding)(ding)或者要(yao)求(qiu)經(jing)營、購買、使用(yong)(yong)本(ben)(ben)(ben)地特定(ding)(ding)企業提供的(de)商品(pin)(pin)服務的(de)行(xing)(xing)為(wei)(wei);濫用(yong)(yong)行(xing)(xing)政(zheng)(zheng)權力(li)對外地商品(pin)(pin)服務設(she)定(ding)(ding)歧(qi)視性(xing)技術要(yao)求(qiu)、檢驗標準(zhun)等,阻礙(ai)(ai)、限制其進入(ru)本(ben)(ben)(ben)地市(shi)場的(de)行(xing)(xing)為(wei)(wei);濫用(yong)(yong)行(xing)(xing)政(zheng)(zheng)權力(li)對外地商品(pin)(pin)服務設(she)置歧(qi)視性(xing)補貼政(zheng)(zheng)策或者收費標準(zhun)的(de)行(xing)(xing)為(wei)(wei);濫用(yong)(yong)行(xing)(xing)政(zheng)(zheng)權力(li)要(yao)求(qiu)企業采(cai)購本(ben)(ben)(ben)地產品(pin)(pin),或者通過給予財政(zheng)(zheng)補貼等方式,鼓勵引導本(ben)(ben)(ben)地企業之間相互采(cai)購的(de)行(xing)(xing)為(wei)(wei)等。

妨礙(ai)企(qi)業公(gong)平參(can)與異地經(jing)(jing)(jing)營(ying)(ying)(ying)(ying)類問題包括,濫(lan)用行政權(quan)力設(she)定歧視性的(de)(de)資質要求或者(zhe)評審標準(zhun),排(pai)斥外地企(qi)業參(can)加本地招(zhao)標采購(gou)或者(zhe)其(qi)他(ta)經(jing)(jing)(jing)營(ying)(ying)(ying)(ying)活動的(de)(de)行為;濫(lan)用行政權(quan)力設(she)置不合理的(de)(de)名錄(lu)庫(ku)、資格(ge)庫(ku),排(pai)斥限制外地企(qi)業在本地開展經(jing)(jing)(jing)營(ying)(ying)(ying)(ying)活動的(de)(de)行為;違法設(she)置或者(zhe)授予特許(xu)經(jing)(jing)(jing)營(ying)(ying)(ying)(ying)權(quan),妨礙(ai)其(qi)他(ta)經(jing)(jing)(jing)營(ying)(ying)(ying)(ying)者(zhe)公(gong)平競爭的(de)(de)行為等。

設置地(di)方(fang)保(bao)護和(he)市(shi)場(chang)分割(ge)隱(yin)性(xing)門檻類問題包(bao)括,濫(lan)用(yong)(yong)行政權力利用(yong)(yong)信用(yong)(yong)評價等手段(duan)設置外(wai)地(di)企業(ye)市(shi)場(chang)進入(ru)隱(yin)性(xing)限制的(de)(de)行為;濫(lan)用(yong)(yong)行政權力借助地(di)方(fang)標(biao)準等變相(xiang)阻礙外(wai)地(di)企業(ye)、商品服務進入(ru)本地(di)市(shi)場(chang)的(de)(de)行為;濫(lan)用(yong)(yong)行政權力通過與(yu)特(te)定(ding)經營者(zhe)簽訂(ding)合作協議、備忘錄等,妨礙其他經營者(zhe)進入(ru)相(xiang)關(guan)市(shi)場(chang)的(de)(de)行為等。

 

市場監管總局:出臺37條重點舉措支持民營企業發展,加強涉企收費政策措施合規審查

近(jin)日,市場監管總局印發《貫徹落實民營企業座談會精神(shen)重點(dian)舉措清單(dan)》(以下(xia)簡稱(cheng)《清單(dan)》),提出37條(tiao)重點(dian)舉措。

黑龍江:全面規范涉企行政檢查,嚴禁干擾企業正常生產經營

近日,黑(hei)龍江省(sheng)人民政(zheng)府(fu)新(xin)聞辦(ban)公室召開新(xin)聞發布(bu)會,圍(wei)繞黑(hei)龍江省(sheng)認真落實《國務院辦(ban)公廳關于(yu)嚴格規范涉企行(xing)(xing)政(zheng)檢查的(de)(de)(de)意見》的(de)(de)(de)有(you)關情況(kuang)進行(xing)(xing)介(jie)紹(shao)。會上,黑(hei)龍江省(sheng)司法(fa)廳廳長(chang)崔永洪介(jie)紹(shao),聚焦企業(ye)反映強烈(lie)的(de)(de)(de)突出(chu)問題(ti),黑(hei)龍江省(sheng)對行(xing)(xing)政(zheng)檢查進行(xing)(xing)全方位、全鏈條、全覆蓋的(de)(de)(de)規范,一共25項工作措施,可以概括(kuo)為“三(san)個(ge)明確”“四(si)個(ge)嚴格”。

“三個明確”:一(yi)(yi)是(shi)明確檢(jian)(jian)查(cha)(cha)(cha)主(zhu)(zhu)體。檢(jian)(jian)查(cha)(cha)(cha)主(zhu)(zhu)體嚴格限定為具有行(xing)政執法(fa)(fa)(fa)權的(de)(de)行(xing)政機(ji)關、法(fa)(fa)(fa)律法(fa)(fa)(fa)規授權的(de)(de)組織(zhi)以及受(shou)委(wei)托的(de)(de)組織(zhi),而且檢(jian)(jian)查(cha)(cha)(cha)主(zhu)(zhu)體資格必須(xu)(xu)依法(fa)(fa)(fa)確認并向社(she)會公(gong)(gong)告,嚴禁不(bu)具備主(zhu)(zhu)體資格實施行(xing)政檢(jian)(jian)查(cha)(cha)(cha)。二(er)是(shi)明確檢(jian)(jian)查(cha)(cha)(cha)事項(xiang)(xiang)。行(xing)政執法(fa)(fa)(fa)部門必須(xu)(xu)對本領域現有檢(jian)(jian)查(cha)(cha)(cha)事項(xiang)(xiang)進行(xing)梳(shu)理,沒有法(fa)(fa)(fa)定依據的(de)(de)一(yi)(yi)律清(qing)理,法(fa)(fa)(fa)定依據變化(hua)的(de)(de)一(yi)(yi)律調(diao)整,沒有成效的(de)(de)一(yi)(yi)律取消;必須(xu)(xu)將(jiang)行(xing)政檢(jian)(jian)查(cha)(cha)(cha)事項(xiang)(xiang)向社(she)會公(gong)(gong)布(bu),未經(jing)公(gong)(gong)布(bu)的(de)(de)不(bu)得實施。三是(shi)明確檢(jian)(jian)查(cha)(cha)(cha)方式(shi)。行(xing)政檢(jian)(jian)查(cha)(cha)(cha)能合(he)(he)并的(de)(de)合(he)(he)并,能聯(lian)合(he)(he)的(de)(de)聯(lian)合(he)(he),能通過書面核(he)查(cha)(cha)(cha)、信息共享、智慧監(jian)管等方式(shi)監(jian)管的(de)(de),不(bu)得入企(qi)(qi)實施現場檢(jian)(jian)查(cha)(cha)(cha)。嚴控入企(qi)(qi)檢(jian)(jian)查(cha)(cha)(cha)人員數(shu)量,優化(hua)“綜合(he)(he)查(cha)(cha)(cha)一(yi)(yi)次”“雙隨機(ji)、一(yi)(yi)公(gong)(gong)開”抽查(cha)(cha)(cha);嚴控入企(qi)(qi)檢(jian)(jian)查(cha)(cha)(cha)頻次,執法(fa)(fa)(fa)部門必須(xu)(xu)公(gong)(gong)布(bu)對同一(yi)(yi)企(qi)(qi)業實施行(xing)政檢(jian)(jian)查(cha)(cha)(cha)的(de)(de)年度頻次上限。

“四個(ge)嚴(yan)(yan)(yan)格(ge)”:一(yi)是嚴(yan)(yan)(yan)格(ge)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)標(biao)準、程(cheng)序。必須(xu)嚴(yan)(yan)(yan)格(ge)執行(xing)(xing)(xing)國(guo)務(wu)院(yuan)相(xiang)關部門公布的(de)行(xing)(xing)(xing)政檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)標(biao)準,落實(shi)(shi)(shi)行(xing)(xing)(xing)政裁量權基準制度。必須(xu)嚴(yan)(yan)(yan)格(ge)按(an)照規定程(cheng)序實(shi)(shi)(shi)施(shi)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha),也(ye)就(jiu)是檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)前有(you)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)方案,檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)時(shi)有(you)通知書、亮執法(fa)證(zheng)和(he)(he)“檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)碼”、做檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)筆錄,檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)后(hou)告知檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)結果。二是嚴(yan)(yan)(yan)格(ge)控制專項(xiang)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)。對某(mou)一(yi)地區(qu)、某(mou)一(yi)領域的(de)突出問(wen)題(ti)實(shi)(shi)(shi)施(shi)專項(xiang)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha),必須(xu)經評估符合監管需要,必須(xu)嚴(yan)(yan)(yan)格(ge)控制數(shu)(shu)量、范圍、內(nei)容和(he)(he)時(shi)限,必須(xu)擬訂檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)計劃并報批(pi)準和(he)(he)公示。三是嚴(yan)(yan)(yan)格(ge)規范檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)行(xing)(xing)(xing)為。必須(xu)做到“五個(ge)嚴(yan)(yan)(yan)禁”“八個(ge)不(bu)(bu)(bu)得(de)(de)”,嚴(yan)(yan)(yan)禁逐利檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha),不(bu)(bu)(bu)得(de)(de)接(jie)受被(bei)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)企(qi)(qi)(qi)業(ye)(ye)(ye)的(de)任何饋贈、報酬、福(fu)利待遇(yu),不(bu)(bu)(bu)得(de)(de)參加被(bei)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)企(qi)(qi)(qi)業(ye)(ye)(ye)提供的(de)宴請、娛(yu)樂、旅游等(deng)活(huo)動,不(bu)(bu)(bu)得(de)(de)由被(bei)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)企(qi)(qi)(qi)業(ye)(ye)(ye)支付消費開支或者將檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)費用(yong)轉嫁給企(qi)(qi)(qi)業(ye)(ye)(ye),不(bu)(bu)(bu)得(de)(de)強制企(qi)(qi)(qi)業(ye)(ye)(ye)接(jie)受指定的(de)中介機(ji)構(gou)提供服務(wu);嚴(yan)(yan)(yan)禁干擾企(qi)(qi)(qi)業(ye)(ye)(ye)正常(chang)生(sheng)產經營,不(bu)(bu)(bu)得(de)(de)刻意要求法(fa)定代表(biao)人到場;嚴(yan)(yan)(yan)禁任性處罰企(qi)(qi)(qi)業(ye)(ye)(ye),不(bu)(bu)(bu)得(de)(de)亂(luan)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)封(feng)、亂(luan)扣押(ya)、亂(luan)凍結、動輒責(ze)令(ling)停產停業(ye)(ye)(ye);嚴(yan)(yan)(yan)禁下達檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)指標(biao),不(bu)(bu)(bu)得(de)(de)將考(kao)核考(kao)評、預算項(xiang)目績效與檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)頻次(ci)、罰款(kuan)數(shu)(shu)額掛鉤;嚴(yan)(yan)(yan)禁變相(xiang)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha),不(bu)(bu)(bu)得(de)(de)以觀摩(mo)、督(du)導(dao)、考(kao)察等(deng)名義行(xing)(xing)(xing)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)之實(shi)(shi)(shi)。四是嚴(yan)(yan)(yan)格(ge)落實(shi)(shi)(shi)責(ze)任。緊(jin)盯(ding)社會關切,暢通企(qi)(qi)(qi)業(ye)(ye)(ye)投訴舉報渠(qu)道(dao),拓寬線索來源。創新監督(du)方式,強化數(shu)(shu)字(zi)技術賦能,加強行(xing)(xing)(xing)政執法(fa)監督(du)信息系統建設及應用(yong)。嚴(yan)(yan)(yan)肅追責(ze)問(wen)責(ze),對亂(luan)檢(jian)(jian)(jian)(jian)查(cha)(cha)(cha)(cha)(cha)(cha)(cha)問(wen)題(ti)發現一(yi)起、查(cha)(cha)(cha)(cha)(cha)(cha)(cha)處一(yi)起。


四川:推動小微企業上規提質,對戶數增加的市(州)給予財政激勵

近日,四川省政府辦公廳印(yin)發《關于推動小(xiao)微(wei)企業上規提(ti)質的若干措施》,明確(que)建(jian)立小(xiao)微(wei)企業培育庫、開展專項服(fu)務、強化激(ji)勵獎補(bu)等(deng)8條措施,支持(chi)小(xiao)微(wei)企業發展。

《措施(shi)》適(shi)用(yong)于(yu)四川行政區域內工業、服(fu)務業小(xiao)微(wei)企(qi)(qi)業中還未納(na)入規模以(yi)上統計和首次(ci)納(na)入規模以(yi)上統計三年(nian)內的企(qi)(qi)業。8條措施(shi)促進小(xiao)微(wei)企(qi)(qi)業“愿升”“敢升”“會升”,推動全省小(xiao)微(wei)企(qi)(qi)業進一步上規模、提(ti)質效。

促進企(qi)(qi)業(ye)(ye)(ye)(ye)“愿升(sheng)”方面(mian),將從開展專項服(fu)(fu)務、強(qiang)化激勵獎補(bu)、支持(chi)研發技(ji)改、加大金融支持(chi)、落(luo)實減稅降(jiang)費(fei)、強(qiang)化要(yao)素保(bao)障等(deng)方面(mian),激發小微企(qi)(qi)業(ye)(ye)(ye)(ye)上規提(ti)質積極性。比如,各地要(yao)對新達(da)規重點企(qi)(qi)業(ye)(ye)(ye)(ye)(首次達(da)規入統三年內的企(qi)(qi)業(ye)(ye)(ye)(ye))建立聯系服(fu)(fu)務機(ji)制,定(ding)期(qi)組織相關部門(men)與企(qi)(qi)業(ye)(ye)(ye)(ye)面(mian)對面(mian)交流(liu);省級財政對“小升(sheng)規”企(qi)(qi)業(ye)(ye)(ye)(ye)戶(hu)數增加的市(州),按工(gong)業(ye)(ye)(ye)(ye)企(qi)(qi)業(ye)(ye)(ye)(ye)8萬(wan)元、服(fu)(fu)務業(ye)(ye)(ye)(ye)企(qi)(qi)業(ye)(ye)(ye)(ye)4萬(wan)元、商貿業(ye)(ye)(ye)(ye)企(qi)(qi)業(ye)(ye)(ye)(ye)2萬(wan)元的戶(hu)均標準(zhun)給予財政激勵等(deng)。

四(si)川將推動(dong)新(xin)達(da)規(gui)(gui)重(zhong)(zhong)點(dian)企(qi)(qi)業(ye)(ye)(ye)發(fa)(fa)展(zhan)新(xin)質生產力。比如,支(zhi)(zhi)持新(xin)達(da)規(gui)(gui)重(zhong)(zhong)點(dian)企(qi)(qi)業(ye)(ye)(ye)新(xin)建(jian)(jian)或在建(jian)(jian)研(yan)發(fa)(fa)平臺,對(dui)近(jin)兩年內核定投入超過500萬元(yuan)且達(da)到建(jian)(jian)設標(biao)準的項目,按照核定總額的30%、每(mei)個項目最高不(bu)超過200萬元(yuan)給(gei)予支(zhi)(zhi)持。充分發(fa)(fa)揮支(zhi)(zhi)持小(xiao)(xiao)微(wei)企(qi)(qi)業(ye)(ye)(ye)融資協調(diao)工作(zuo)機制(zhi)作(zuo)用(yong),常(chang)態(tai)長(chang)效開展(zhan)金(jin)融顧問服務,為新(xin)達(da)規(gui)(gui)重(zhong)(zhong)點(dian)企(qi)(qi)業(ye)(ye)(ye)提(ti)供融資融智支(zhi)(zhi)持;全面落(luo)實支(zhi)(zhi)持小(xiao)(xiao)微(wei)企(qi)(qi)業(ye)(ye)(ye)發(fa)(fa)展(zhan)的各(ge)項稅費優(you)惠政策;各(ge)地(di)在用(yong)能、用(yong)房、用(yong)地(di)、用(yong)人、用(yong)工等(deng)(deng)要素保障(zhang)方面積(ji)極(ji)給(gei)予培育庫企(qi)(qi)業(ye)(ye)(ye)和新(xin)達(da)規(gui)(gui)重(zhong)(zhong)點(dian)企(qi)(qi)業(ye)(ye)(ye)支(zhi)(zhi)持等(deng)(deng)。

“敢升”方面,將規范執法檢查(cha)(cha),對違(wei)反規定實施行政檢查(cha)(cha)的行為,支持企業拒絕并投(tou)訴舉(ju)報;全面推廣(guang)首違(wei)不罰(fa)清(qing)單、輕微違(wei)法免予處罰(fa)清(qing)單,引導企業按照(zhao)國家相(xiang)關(guan)規定積極(ji)開展信用修復等,消(xiao)除企業顧(gu)慮。

“會升”方面,將建立(li)小微企(qi)(qi)業培育庫,各級(ji)經濟(ji)和信息化、商務、科(ke)技、稅務等(deng)部門(men)加(jia)強對庫內企(qi)(qi)業政策扶持、培育發展、財(cai)稅知識、現代企(qi)(qi)業制度等(deng)方面的培訓(xun)和輔導,及時跟進企(qi)(qi)業生產(chan)運行情況(kuang),協(xie)調解決(jue)生產(chan)經營(ying)中有關困難問題,指導“個轉(zhuan)企(qi)(qi)”“小升規”。
